Most hiring processes are initiated by HR, which sees hiring as one of the few ways to justify its existence. Smart companies wouldn't have HR departments. Hiring should be done by managers, legal issues can be handled by the corporate attorneys. HR is a non-position that should never have come into existence because it leads to the kinds of absurdities illustrated in Tabitha's article.
