One of the problems of such cases is that we rely on witness reports rather than hard evidence such as photographs of the scene. As we know people, even when supposedly trained to observe, are absolutely unreliable witnesses; and as we know human memory is absolutely not to be relied upon in any way, we're left with an enormous area of potential uncertainty regarding the basic facts of the case. It is unwise to assume the "facts" as stated actually represent the real conditions pertinent to the event.
